Yes. As currently set forth in the C.A.R. Model MLS Rules, a data display disclaimer is required. The purpose is to provide liability protection for Participants and the MLS, as
well as the display host. The disclaimer should be set forth in a manner readily visible to consumers but not less than 7pt type, and provide the following, or substantially similar,
notice:
"Based on information from the _____________ Association of REALTORS® (alternatively, from the __________ MLS) as of _________ (date the AOR/MLS data was obtained).
All data, including all measurements and calculations of area, is obtained from various sources and has not been, and will not be, verified by broker or MLS. All information should be
independently reviewed and verified for accuracy. Properties may or may not be listed by the office/agent presenting the information."
Displays of minimum information (e.g.
a one-line or thumbnail search result, text messages, "tweets", etc. of two hundred (200) characters or less) are exempt from this requirement but only when linked directly to a display
that includes the required disclosure.
